By using this Site, you represent and warrant that you are the legal age of majority under applicable law to form a binding contract with The Calgary Jazz Orchestra Society.
1. License
The Calgary Jazz Orchestra Society (“The Calgary Jazz Orchestra Society” or “us” or “we”) grants you a limited non-exclusive, non-transferable license to access and make personal use of the Site for non-commercial use, provided the Site is not modified or downloaded (other than page caching) unless expressly authorized by The Calgary Jazz Orchestra Society. You will be fully responsible for any consequences resulting from any such use. This license does not include any right for resale or commercial use of the Site or its content. No derivative use of the Site or its contents or any use of data mining, robots, or similar data-gathering and extraction tools is permitted. Any unauthorized use of the Site will terminate the license and all the limited rights or permission granted by The Calgary Jazz Orchestra Society.

If you provide us with your contact information you agree that The Calgary Jazz Orchestra Society may send you communication by email or otherwise about the Site, The Calgary Jazz Orchestra Society, Contents, and Material. You must not use such marks without the prior written permission of The Calgary Jazz Orchestra Society. 5. Participation in online discussion groups, comments & other communications
You may post or submit comments, suggestions, ideas, questions, or other information to The Calgary Jazz Orchestra Society, provided the content is not illegal, obscene, defamatory, threatening, an invasion of privacy, objectionable or infringing of intellectual property rights of third parties, and does not consist of or contain software viruses, commercial solicitation or any form of “spam”. The owner of the Site is located in Alberta, Canada. The Calgary Jazz Orchestra Society provides this Site for use only by persons located in Canada. 12. Governing law and jurisdiction
The use of the Site and any purchase made on this Site are governed by the laws in force in the Province of Alberta and Canada. You agree and submit to the exclusive personal jurisdiction and venue of the courts located in Calgary, Alberta. The United Nations Convention on Contracts for the International Sale of Goods will not apply.
13. Description of donation and other tools terms
If you choose to make a donation to The Calgary Jazz Orchestra Society you authorize The Calgary Jazz Orchestra Society and its agents to deduct any donation and fees you approve by using the donation tool. In addition to these Terms of Use, some donation tools and other tools are subject to a separate additional license terms of use which are as published by the tool.
14. Request for permission or further information
Any use beyond the scope permitted by these Terms of Use requires express written permission from The Calgary Jazz Orchestra Society.
15. Waiver
No failure to exercise, or delay in exercising, any right, remedy, power or privilege arising from these Terms of Use operates, or may be construed, as a waiver thereof. No single or partial exercise of any right, remedy, power or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power or privilege.
16. Entire Agreement
These Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and The Calgary Jazz Orchestra Society regarding the Site and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding such subject matter.
